This is a special status that applies at EU level to people who have fled the war in Ukraine. It is available to all who lived in Ukraine before February 24, 2022 and arrived in Luxembourg after February 24, 2022 or shortly before.
Temporary protection applies to persons displaced from Ukraine who suffered as a result of the military invasion of the Russian armed forces, and comes into force on February 24, 2022, because this is the date of the beginning of Russia’s war against Ukraine. The relevant status applies to citizens of Ukraine who belong to one of the following categories
- Citizens of Ukraine who lived in Ukraine until February 24, 2022;
- stateless persons and citizens of third countries, except Ukraine, who have been granted international protection or equivalent national protection in Ukraine until February 24, 2022;
- family members of the persons referred to in paragraphs 1 and 2, regardless of the nationality of the family members.
- stateless persons and citizens of third countries other than Ukraine who can prove that they have legally resided in Ukraine until February 24, 2022 on the basis of a valid residence permit issued in accordance with the legislation of Ukraine and who cannot return to their country or region of origin in safe and durable conditions.
- husband / wife of the person;
- unmarried minor children of the persons referred to in paragraphs 1 or 2, or their spouse, regardless of whether they are legal, born out of wedlock or adopted;
- other close relatives who, at the time of the mass resettlement of displaced persons, lived in the family center and who were wholly or mainly dependent on the person referred to in paragraphs 1 or 2;
Exclusions:
- persons in respect of whom there are serious grounds for believing that: they have committed a crime against peace, a war crime or a crime against humanity, as defined in international instruments designed to settle such crimes;
they committed a serious crime under customary law outside the Grand Duchy of Luxembourg before they were adopted as - persons who have temporary protection;
- they were guilty of acts contrary to the purposes and principles of the United Nations;
- persons if there are reasonable grounds to consider them a threat to national security or if they have been convicted by a final sentence of a particularly serious crime that they pose a threat to the Luxembourg community.
